Frequently Asked Questions

  • How does land sale conveyancing work?

The first step is for the seller to instruct a conveyancer to act on their behalf. The conveyancer will then draft a contract of sale, which will set out the terms and conditions of the land sale. Once this contract has been signed by both parties, the conveyancer will then begin the process of transferring ownership of the property. This involves a number of different tasks, including carrying out searches and ensuring that there are no outstanding mortgages or other charges against it. The conveyancer will also liaise with the local authority in order to obtain any necessary planning permissions. Once all of these tasks have been completed, the conveyancer will arrange for the transfer of ownership to be registered at the Land Registry.

  • Can I do my own land conveyancing in NSW?

All conveyancing transactions are now carried out via the electronic settlement system, PEXA.  Only licensed conveyancers and solicitors have access to this system.
